VLADIMIR GOUTENEV: TERM OF MUTUAL SETTLEMENTS IN GOVERNMENT CONTRACTS MUST BE LIMITED TO 30 DAYS
The Committee Economic Policy, Industry, Innovative Development and Entrepreneurship has approved a bill providing a mandatory customer’s payment for the delivered goods or performed work in no more than 30 days from the date of signing the document of acceptance of the goods or work. If it does not occur the penalties take effect.
At a meeting of the Committee it was stated that customers consciously include long-term settlements to the contracts. The national average for the term of mutual settlements is 3 months, quite common cases when terms of mutual settlements reaching up to 8 months. The amount of outstanding payments of the government customers exceed 33 billion rubles.
Representatives of the Communist Party faction made a proposal to extend compulsory payment by customer for delivered goods or performed work up to 60 days and to release the customer from payment of fines and penalties for inadvertent breach.
Commenting on his colleagues's proposal the first deputy chairman of the Committee of the Duma Mr. Vladimir Gutenev noted that such a proposal is unlikely to discipline government customers and to provide an opportunity for business development.
"Surely there should be more business. But how could it be more if on the one hand there are trading networks that set stringent requirements for commodity credits and possibility to return unsold goods, and the other hand, public authorities which carefully control what are their financial opportunities and compare them with their “appetites”, also want to keep the right to pay when they deem it necessary. Here corruption possibilities are often hiding", - Mr. Gutenev said.
The most of the members of Committee agreed with the fact that artificial delay of payment occurs often. They were in favor of the bill explaining it by the need to support business and saying that, for example, with municipal budget planning and adjusting limits officials are aware that they can buy and whether this funding.
"I want to remind you that the deputies are nominees from the people, but not the former mayors and leaders. Along with emerging cash gaps of which former representatives of the municipalities try to tell us necessary that there were personnel changes. We have heard about the facts that when minimum balances emerging in the banks it motivates some leaders to delay payments to performers and to pay to close businesses as soon as possible", - said Gutenev.
