The State Duma adopted in the second reading a bill that excludes the obligation on the part of executors of the state defense order (State Defense Order) to post public procurement information in a unified public procurement information system. The bill was initiated by a group of deputies led by the first deputy chairman of the committee on economic policy, industry, innovative development and entrepreneurship Vladimir Gutenev.

Currently, GOZ executors are required to post a procurement plan on the Internet, while the current legislation does not provide for exceptions for purchases within the framework of the state defense order. At the same time, specifying in the procurement plan and posting on the Internet procurement information as part of the state defense order is unacceptable in view of the fact that, according to the directives of the Government of the Russian Federation and the collegium of the military-industrial complex of the Russian Federation, the information provided for by the law on state defense orders cannot be placed on public Internet sources, the authors remind document.

"State contracts, as a rule, contain a technical task that has a secrecy stamp," - noted in the explanatory note. Placing the aggregate of such information in open sources, including in a unified information system, taking into account the assignment of identifiers for the state contract, allows you to collect and reproduce the terms of reference for the constituent elements, which may harm the interests of national security and defense, the authors of the bill indicate.

In addition, given the effect of international sanctions on defense industry enterprises, the disclosure of procurement information actually means “publicly disclosing information on the interaction of suppliers with a person on the sanctions lists, which entails negative consequences for suppliers (discrediting suppliers, including such suppliers in sanctions lists, cancellation of export licenses), as well as for defense industry enterprises, "says the accompanying materials to the document.

The draft law provides for the possibility of closed procurement in the framework of the state defense order to ensure the defense and security of the Russian Federation in terms of orders for the creation, modernization, supply, repair, maintenance and disposal of weapons, military and special equipment, for the development, production and supply of space equipment and objects space infrastructure, as well as non-placement of information on such purchases in a single information system in the field of procurement of goods, works, services to ensure public aromatic and municipal needs.
